It's been known to happen. Usually you wait longer than a few months of silence, and it's important to acknowledge the original author, and be absolutely sure that you can keep up the quality. If you can do that, then it all boils down to whether the author actually abandoned the story or not. If so, you're in the clear. This is the old internet, after all. I agree hooked6. It would be theft of intellectual property without written permission. Some authors will willing give their permission. Many, however, won't.
